Terms and Conditions

We hope you will enjoy your Private Charter (herein referred to as Charter) with Anglia Sea Ventures Ltd (herein referred to as the Company). We ask you to read this section carefully as it contains important information.

Charter timings
The yacht will be available for Charter at the agreed time and date. The Charterer must return the yacht to its base free of indebtedness at the end of the Charter period. The yacht must be cleaned, her gear stowed as per the inventory, with empty holding tanks, full fuel and water tanks, be clear of all personal effects and be fit for re-charter by 1600 hours on the last day of the Charter ready for inspection by the Company. The Company must be informed as soon as possible if you will be late. We reserve the right to charge a late return penalty at twice the daily Charter rate, for every day or part day by which return is delayed.  Before the commencement of the Charter the Charterer is invited to inspect the yacht to satisfy himself that it is in seaworthy condition and is in good working order.  The Company does not warrant the fitness of the yacht in all conditions of weather for any particular cruise or passage within the cruising limits.

Breakdown or accident
In the event of any accident or breakdown of the yacht, its machinery and/or equipment the Charterer must inform the Company at the earliest opportunity. Although it must be reported, engine breakdown in an auxiliary yacht is not deemed to make the yacht unfit for use. The Charterer must comply with any reasonable instructions given by the Company or the insurers. No repairs are to be put in the hands of any other party without the prior consent of the Company. In order that the Company can re-charter the yacht on its return, the Charterer must report damage or loss of equipment to the Company as soon as possible. 

Experience
The skipper of the Charter vessel must be suitably experienced and/or qualified

i) Must hold an RYA Coastal Skipper practical certificate and have sailed at least 1000 Nm. or ii) Has skippered a similar yacht for at least 3 seasons in the area to be covered by this Charter.

The Charterer guarantees that he/she will accept full responsibility for the safe navigation of the yacht and its crew at all times during the Charter period, including the security of the yacht while at anchor or in harbour or otherwise left unattended. 

We are sorry but bookings cannot be accepted from novices or anyone under 25 years of age.

On acceptance of the yacht any necessary instructions will be given regarding its use and equipment. If in the opinion of the Company the Charterer is not suitable to take charge of the vessel, the Company reserves the right to refuse to hand over the yacht. In this event all money paid will be refunded in full and the Charterer will have no further claim against the Company.

The Charterer must limit the number of his party to not exceed the number of berths or capacity of the liferaft.

Cruising limits
Cruising limits will be agreed with individual Charterers and will be set out in the Charter agreement.

Payment
A deposit of 25% of the Charter fee is required at the time of booking. The balance of the Charter fee, must be paid at least four weeks before commencement of the Charter.

Security Deposit
A security deposit is required and will be returned if the yacht is returned in a satisfactory condition at the appointed time and place. The security deposit must be paid before the commencement of the Charter. The Company may apply the security deposit in reduction of:
a) any liability of the Charterer to the Company.
b) the cost of any loss or damage to the vessel, her equipment or furnishings during the Charter period.
c) cleaning charges, holding tank pump out charges, or diesel fuel used.
c) loss of earnings by the company due to the yacht not being returned in a fit state to re-charter.

The security deposit shall be returned to the Charterer less any reductions mentioned above within 14 days after the delivery of the yacht, or, in the event of a dispute, upon the determination of such dispute. The whole security deposit will be forfeited in the event of an insurance claim.

Refunds/cancellation/amendments
If you decide to cancel your Charter, we will happily arrange a full refund so long as you contact us within 14 days of booking. If you choose to cancel or amend after this date, you may do so up to 4 weeks prior to departure/commencement of your Charter but we reserve the right to charge you a booking fee of 25% of the cost. Refunds will be in the same form as the original payment to the Charterer and no interest will be paid on the amount to be refunded. We regret that it is not possible to cancel or amend a Charter less than 4 weeks from the departure/commencement date. However should you wish to do so, we will make every effort to re-let the vessel and if successful we will let you rebook. We recommend the Charterer takes out travel insurance in case you have reason to cancel.

If we cancel or change your Charter
Some Charters may be cancelled due to mechanical failure, or for other reasons beyond our control and if this happens we will tell you as soon as possible. If your Charter is cancelled for this reason, you will be offered an alternative vessel or you will be given the opportunity to rebook or
the Company will refund all money paid. We are unable to reimburse travel, accommodation or other incidental expenses incurred by you and the Charterer will have no further claim.

Restrictions
To operate within the safety parameters of the life saving equipment on board the maximum chest or waist size is 50 inches (127cm) which ever is the greater. We are sorry but no pets are allowed onboard and no smoking is allowed on-board nor ashore when wearing lifejackets or wet weather gear belonging to the Company. All members of the party aboard the vessel are required to disclose any relevant medical conditions on the Company's form prior to commencement of your Charter.

Insurance
Comprehensive insurance of the yacht is included in the Charter fee, including third party liability up to £1,000,000. The insurance does not cover personal effects (including motor vehicles left at the base) nor does it cover loss or damage to sails, dinghies that are towed behind the yacht, or any use of the yacht other than cruising for pleasure purposes.

The Charterer shall indemnify the Company in respect of any loss or damage to the yacht, her equipment or furnishings or other expense by reason of negligence or breach of contract of the Charterer or any member of his party. Including any loss or damage after the Charter period, but attributable to any act, default or negligence of the Charterer or any member of his party.

The Charterer shall not sub-let or part with the control of the yacht without the written consent of the Company.

Prices
We reserve the right to change prices without notice, provided we inform you before the order has been processed and payment has been taken. Prices in our brochure and website are inclusive of VAT where applicable.

The Company cannot be held responsible for any inaccuracy in its marketing materials or equipment descriptions which may exist and reserves the right to change equipment where necessary.

Liability
Anglia Sea Ventures Ltd, its servants, agents, instructors and sailing masters do not accept any responsibility for any loss damage or injury suffered by any persons and/or their property arising out of or during the course of their Charter whilst cruising, training, instructing or otherwise unless such loss or damage was caused by or resulted from negligence.

These terms and conditions do not affect your statutory rights as a consumer, and are governed by and in accordance with English law. The Charterer and Anglia Sea Ventures Ltd agree that any problems fall under the jurisdiction of the English courts. All the clauses and sub clauses in our terms and conditions are independent of each other. If one clause or sub clause is invalid or unenforceable, this will not affect any other clause or sub clause.

In case of problems
In case of a problem, please speak to the Company on the day, so they have the opportunity to resolve any problems there and then.
